Covid-19 force majeure contract review platform brought to market in rapid time
Challenge: As the pandemic continues to impact companies worldwide and countries move in and out of lockdown, in-house legal teams stretched and displaced, conventional human-led large-scale commercial contract review proves challenging.
A&O has developed a tech-enabled review that answers the key questions our clients need answers to - does force majeure include epidemics or virus outbreaks? Within what period must an event be notified in order to obtain relief from contractual performance? How must that notice be delivered to be valid? The unique capability of the tool is that its customised coding picks up the provisions and replaces what would be a human review with an automated AI review to answer these questions. It then converts the text of those provisions into data visualisations on a shared online platform so the in-house legal team, A&O lawyers, local counsel and others can rapidly visualise exposure worldwide.
Although 2 million documents were collected, our team’s application of standard and bespoke culling measures brought that number down to just 130,000 documents. The use of technology further reduced the number of documents requiring human review as Technology Assisted Review (TAR) effectively amplified manual coding decisions across the remaining documents, thereby reaching the facts of the matter faster.

Helping a multinational telecommunications business with a large-scale deed portfolio review
Challenge: Review more than 450 real estate deeds over 750 properties within a limited timeframe, which looked unachievable using manual processes.
