Jennifer Marshall

Jennifer advised a large number of counterparties of Lehman Brothers and the Icelandic banks following the failure of those entities. In particular, she advised one of the parties in the Lehman Brothers International (Europe) (LBIE) client money directions application (which went to the Supreme Court) and one of the parties in the LBIE Waterfall Application. She is currently advising the lenders and the receivers in relation to the OW Bunker group which collapsed in November 2014. This involves insolvency proceedings in a large number of different jurisdictions across the world.

A significant part of Jennifer’s practice is the drafting of opinions required by regulators under European legislation concerning the potential impact of the insolvency or resolution of financial institution counterparties.

Jennifer is also responsible for keeping clients up to date with recent developments including the European Regulation on Insolvency Proceedings, the possible implications of Brexit and legislation in relation to failing banks, and has given a number of presentations in this regard. She is also a member of various working groups considering the impact of Brexit on insolvency proceedings and has recently advised a London clearing house on the potential impact of Brexit on issues relating to financial collateral and settlement finality.

Jennifer is the chairman of the Insolvency Subcommittee of the City of London Law Society and the former President of the Insolvency Lawyers Association. She is a member of the Banking Liaison Panel, a working group established by HM to consider bank and investment firm failure.
