If it ain't broke, don't fix it? The Law Commission's review of The Arbitration Act 1996

Allen & Overy’s International Arbitration Group invites you to join a discussion of the reforms of the Arbitration Act 1996 being considered by the Law Commission (and some reforms that are not).

On 30 November 2021, the Law Commission announced it will conduct a review of the Arbitration Act 1996. The aim of the review is to “enhance the experience for those who choose to arbitrate in England and Wales and maintain English law as the gold standard in international arbitrations,” and reflect modern arbitration practices in the Act, which is now 25 years old.

Chaired by Law Commissioner Professor Sarah Green, the panel discussion will examine some specific aspects of the Act, which might be ripe for reform to ensure that English-seated arbitrations continue to meet the needs of users of arbitration in the 21st century.

Topics for discussion include:

  • the power to summarily dismiss unmeritorious claims or defences in arbitration proceedings
  • the procedure for challenging a jurisdiction award
  • the law concerning confidentiality and privacy in arbitration proceedings
