We advised on the key supplier contracts, including nuclear island supplier contracts, conventional island supplier contracts and templates (ie civil works, supply only, supply and erection and erection only), the EPCM contract and various other contracts. The estimated volume of investment for the project amounts to EUR2.8 billion, which makes it the largest investment by a private investor in the history of Slovakia.
Západoslovenská distribučná, a.s. and Východoslovenská distribučná, a.s.
We are representing electricity distribution companies Zapadoslovenská distribučná, a.s. (ZSD) and Východoslovenská distribučná, a.s. (VSD) in a large number of disputes concerning energy regulation in Slovakia including, in particular, in relation to recent significant interventions of the regulatory authority in the business of the ZSE Group and the VSE Group. In particular, we are representing ZSD and VSD in numerous court disputes where the producers of electricity from renewable sources are claiming reimbursement of a regulatory tariff called the “G-tariff”. The G-tariff is a tariff for access to the distribution grid, which was challenged by the renewable electricity producers before the Constitutional Court of the Slovak Republic, resulting in a number of disputes between the electricity producers and the distribution network operators who collect the tariff on behalf of the State.
Zero Bypass Limited
We represent Zero Bypass Limited, a concessionaire in the D4R7 highway project, in the biggest construction arbitration which has ever taken place in Slovakia, arising out of the delay of the project and related time extension and cost increase. The dispute concerns a complex interplay between matters of delay, quantum and impaired financial cash flows. This is an ICC arbitration seated in Vienna.
