Allen & Overy files amicus brief in support of disability rights in reproductive healthcare

A team of Allen & Overy litigators filed an amicus brief in the U.S. Supreme Court in FDA v. Alliance for Hippocratic Medicine, on behalf of the Disability Rights Education & Defense Fund and other organizations and individuals that advocate for the rights of individuals with disabilities. Justin Ormand, senior counsel in the New York office led the team. Oral argument was held on March 26, 2024.

The brief supports the FDA’s brief and advocates in favor of sustaining regulatory actions that have eased access to mifepristone. The brief focuses on the barriers individuals with disabilities face in accessing healthcare that would only be exacerbated by reinstating outdated and medically unnecessary restrictions to medication abortion. The brief emphasizes that imposing such restrictions do not “protect the health or safety of people with disabilities—instead, it disproportionately robs them of accessible health care options that preserve their bodily autonomy and privacy and may even put their health and lives at risk.”
