Florence Ninane is a partner in Allen & Overy LLP's Paris office. She has significant experience in the areas of French and European competition law (mergers, antitrust and state aid issues) and has developed a specific expertise in distribution law matters. She regularly assists companies with their French, EU and multi-jurisdictional merger notifications, and also represents companies in competition law litigation before competition authorities and national courts (in cartel investigations, abuse of dominance, state aid and private enforcement matters).

Florence’s particular areas of sector expertise include energy, finance, internet and consumer goods and she advises various operators in these areas. Her French and international clients include Amazon, BNP Paribas, Bose, Expedia, Pandora, Procter & Gamble, Samsung, SFR, Société Générale, TNT, Total and TripAdvisor.

European Commission imposes interim measures for first time in nearly two decades

The European Commission (Commission) has the power to order companies suspected of engaging in anti-competitive behaviour to stop their conduct pending a final decision in an investigation – so-called “interim measures”. The idea is that interim measures prevent activity which could irreparably damage the market before the Commission has completed its probe and had a chance to sanction the behaviour. But these powers have rarely been used. In fact, they have lain dormant since the IMS Health case 18 years ago, where the Commission imposed interim measures ordering the firm to grant a licence in relation to pharmaceuticals data.
