Dominic has extensive experience advising on complex merger clearances before both the European Commission and UK merger control authorities, as well as abuse of dominance and restrictive agreements investigations.

In the UK, Dominic has advised clients on the merger control aspects of a number of high profile transactions including News Corporation on its proposed acquisition of Sky, Sky on its acquisition of a 17.9% stake in ITV (including before both the Competition Appeal Tribunal ("CAT") and the Court of Appeal) and HBOS on its acquisition by Lloyds (including before the CAT).  Dominic also advised one of the UK’s 6 large energy companies on the Competition and Markets Authority’s investigation into GB energy markets, the largest market investigation undertaken in the UK.

At the European level, Dominic has advised on several major cross border transactions including three Phase II clearances before the EU Commission. Most recently, Dominic advised VimpelCom on the EU merger control approval of its 50/50 Italian mobile telecoms joint venture with CK Hutchison, the first and only ‘four-to-three’ mobile telecoms consolidation cleared by the current EU Competition Commissioner Margrethe Vestager. Dominic has also advised on Hutchison 3G Austria's acquisition of Orange Austria and the 2010 Phase II clearance of Oracle's acquisition of Sun Microsystems.

Dominic is noted in the Legal 500 directory as being recognised by clients as “smart and effective”.

CMA launches digital markets strategy and market study into online platforms and digital advertising

The UK Competition and Markets Authority (CMA) has published a document setting out its digital markets strategy and, in parallel, has launched a market study into online platforms and digital advertising. These developments follow on from a series of independent reports into the digital sector, including the Furman Report in March and the Lear Report in June. They also build on the package of reforms proposed in February by the CMA’s Chairman, Lord Tyrie, as well as statements by its Chief Executive, Andrea Coscelli.

European Commission seeks to impose interim measures for first time in nearly two decades

The European Commission (Commission) has the power to order companies suspected of engaging in anti-competitive behaviour to stop their conduct pending a final decision in an investigation – so-called “interim measures”. The idea is that interim measures prevent activity which could irreparably damage the market before the Commission has completed its probe and had a chance to sanction the behaviour. But these powers have rarely been used. In fact, the last time the Commission imposed interim measures was 18 years ago, against IMS Health, ordering it to grant a licence in relation to pharmaceuticals data.
