Chris is a partner in our banking and finance group, currently based in Singapore. He is highly regarded for his versatility, with experience in a wide range of banking and finance transactions across not only South East Asia, but also more widely across the Asia Pacific region and also in Europe. His diverse experience ranges from complex acquisition finance through to real estate finance, structured lending, syndicated lending and trade finance. He also has experience advising on work outs and distressed situations.

Chris regularly advises leading international and local banks, borrowers, multilateral agencies and development finance institutions on a wide variety of finance transactions across the Asia Pacific region, particularly in ASEAN markets. Chris regularly speaks at industry forums on the latest market practice in financing transactions across a variety of Asian jurisdictions.

The Constitutional Court decision on the enforcement of the fiducia security: is this a new interpretation?

A recent decision by the Constitutional Court of Indonesia led to an interpretation of article 15 of the Fiducia Law in relation to enforcement of fiducia security in Indonesia. The ruling has brought into question the ability of a creditor to enforce fiducia security without the need to get a court order. The ruling also raises an issue on the ability of a creditor to declare an event of default without the need to involve a debtor or to obtain a court ruling
