Pre-marketing in Europe - a comparison of the rules

In March 2017, aosphere launched a guide to pre-marketing in Europe for subsrcibers to our Rulefinder Marketing Restrictions - Asset Management service. The purpose of the guide is to pull together in a single document the current position in relation to pre-marketing across each of the European countries covered by our service.
The divergence among member states in their approach to pre-marketing is an issue that we know our asset management clients are grappling with. It is also an issue on the radar of the European authorities. In a European Commission report published on 24 March 2017, the lack of harmonisation between member states in relation to pre-marketing was highlighted as a key barrier to cross-border investment. Member states were asked to work together to promote convergence in their approaches and a deadline of Q4 2017 was suggested.
