Insurance litigation in Belgium
05 April 2019
One of the areas in which our Belgian insurance team has built market-leading expertise, is insurance litigation. Mis-selling claims are on the rise in Belgium despite an increasingly strict legal framework for the development and distribution of insurance products.
Litigation in the insurance sector may, however, cover a wide variety of legal disputes. Tom Schoors, Bart De Bock and Nick Portugaels have contributed to the 2019 edition of Insurance Litigation which provides an in-depth look at litigious mechanisms, remedies and damages, dispute resolution and arbitration for insurance companies and policyholders, the interpretation and ambiguities of insurance contracts, liability policies and coverage, notice mechanisms and obligations, defence duties, and litigious issues surrounding first-party property and D&O insurance.
