Draft UK law on private antitrust damages - more work needed to align with EU position?

18 June 2013

The UK Government has published a draft law containing provisions on private antitrust damages actions and collective redress in antitrust cases.  Many broad principles are consistent with the EU proposals in these areas which were published only a day earlier.  But as for the details, more work is needed to bring the UK rules in line with the European Commission’s requirements.  And on collective redress the UK needs to decide whether its current stance on collective redress for antitrust damages actions requires a rethink, given its clear contrast to the approach of the Commission.
