CSSF Communication regarding the launch of a new eDesk module for the submission of the AML/CFT Market Entry Form

In a communication published on 8 February 2021, the Commission de Surveillance du Secteur Financier (the CSSF) announced the launch of a new eDesk module in view of the digitalised completion and submission of the AML/CFT Market Entry Form. The module will be effective as of 15 February 2021. 

Formerly submitted in a dedicated Excel format aiming at collecting standardised key information in relation to money laundering and terrorist financing risks of a fund or an investment fund manager (the IFM), the AML/CFT Market Entry Form will have to be initiated and submitted by either the compliance officer in charge of the control of compliance with the professional obligations (“responsable du contrôle du respect des obligations professionnelles” (“RC”)) of the fund/IFM or the person responsible for compliance with the professional obligations (“responsable du respect des obligations professionnelles” (“RR”)) of the fund/IFM.

The completion of the AML/CFT Market Entry Form may be assigned to another employee of the RC’s or RR’s entity or to a third party (via a delegation), yet, the RC and RR will assume the ultimate responsibility for all information provided.

The submission of the AML/CFT Market Entry Form is required in the following context: 

  • in case of a fund: for authorisation or the launch of additional sub-fund(s);
  • in case of an IFM: for authorisation or registration, license extension and modification of qualified shareholding.

In order to allow the eDesk users to get familiar with the new module, a one-month transition period is put in place by the CSSF starting on 15 February 2021. During the transition period the AML/CFT Market Entry Form may be submitted either in the dedicated Excel format or via the new eDesk module. As of 15 March 2021 the only possible way of submission will be the digitalised form via the eDesk platform.
