Copyright litigation in UK (England and Wales): overview

The most senior specialist IP judge in the High Court of England and Wales, Mr Justice Arnold, recently suggested that of all areas of IP, copyright is the most controversial and challenging at present.

The impact of fast-evolving jurisprudence of the Court of Justice of the European Union, and equally (if not more) rapid technological development, is plain.  In general, where there is legal complexity and change, disputes and litigation follow soon after.  This guide (reproduced from Practical Law with the permission of the publishers) written by A&O’s copyright experts gives an overview of the current law in this area and some of the key practice points encountered in copyright litigation.
