In terms of collateral structuring, he advises large US financial institutions on initial margin negotiations facing counterparties located in North and South America.
Charles advises large financial institutions and corporates on the transactional side in a large range of derivatives transactions including loan-linked and securitisation-linked swaps. He works frequently in a cross-border context, drafting ISDA schedules that have multi-jurisdictional aspects. In addition to transactional work, Charles also regularly acts in an advisory capacity, for example, when drafting legal opinions on the enforceability of ISDA Master Agreements entered into between financial institutions and supranational development banks.
Previously, Charles had experience in advising large financial institutions on legal issues relating to IBOR transition and the impact on the cash and derivatives market globally, including a secondment to a predominant global bank to assist their legal team in coordinating their USD LIBOR transition. Separately, he has collaborated with other specialist teams within the firm to advise on contentious cases where the subject matter of proceedings involved derivatives contracts. Charles also has experience of ISDA collateral documentation in respect of longevity hedging insurance and reinsurance transactions
