Is it too good to be true – a revolutionary change in China’s foreign investment regime

On 19 January 2015 the Ministry of Commerce of the People’s Republic of China (MOFCOM) released a draft of the Foreign Investment Law (the Draft Law) and the explanatory note to solicit public opinion.
The Draft Law is intended to replace the various existing Chinese laws and regulations on foreign-invested enterprises and to govern foreign investment under one unified legislation from a much broader perspective. If adopted, the Draft Law will have a far-reaching impact on the existing foreign investment regime.
