  David Esseks

Partner

New York

David's practice focuses on criminal, civil, and regulatory securities litigation and anti-corruption investigations. David's representations include banks and foreign and domestic corporations in connection with US regulatory and criminal investigations concerning securities, commodities, and insider trading offenses, and violations of the Foreign Corrupt Practices Act and the US antitrust laws, as well as individual officers and employees in similar investigations. He has represented banks in the global LIBOR and FX investigations, as well as investigations of CDS trading and bank hiring practices in Asia.

Previously, David was an Assistant United States Attorney for the Southern District of New York and Chief of that office’s Securities and Commodities Fraud Task Force. In that role, he oversaw a staff of 20 prosecutors and coordinated fraud investigations with the Securities and Exchange Commission, Commodity Futures Trading Commission, and FINRA. In 2007, David received the Attorney General’s John Marshall Award for Asset Forfeiture, in recognition of his work in helping to forfeit more than US$1 billion in fraud proceeds to be returned to crime victims.

Mr. Esseks graduated cum laude from Williams College with a B.A. in 1987 and magna cum laude from University of Michigan Law School with a J.D. in 1990 where he was an Articles Editor of the Law Review.

"We use David Esseks, who is truly excellent. A&O has a great financial institutions practice, and Esseks’ familiarity with the challenges of financial institutions in the white-collar area is very strong. He’s got a very cool head and has a calm demeanour in very tense circumstances, which we really appreciate. His resting pulse rate must be zero! He is able to be very creative in difficult circumstances, to come up with solutions to difficult problems that, frankly, I’ve just not thought of. He is very client friendly and well connected, we trust him implicitly.” (Chambers USA 2016: New York Litigation)

"David Esseks is a respected white-collar litigator with impressive experience in investigations arising from matters such as FCPA and securities law violations. Commentators praise his 'very strong strategic sense, his legal understanding and his incredibly calm and unflappable demeanor,' and describe him as 'remarkable - a great asset.'" (Chambers USA 2015: New York Litigation)

Additionally, David is also listed as a noted practitioner in Legal 500 USA 2015: Antitrust Cartel.

"'Exceptionally skilled' David Esseks is praised for his 'very good client manner.' One client notes that 'he is among the most economical and practically minded lawyers I have met who manages very significant investigations. He knows where to deploy his resources.' He has extensive experience in handling white-collar work such as Foreign Corrupt Practices Act (FCPA) and antitrust investigations." (Chambers USA 2014: New York Litigation)

"David Esseks draws on his experience as an Assistant US Attorney for the Southern District of New York when representing both individuals and institutions in multifaceted investigations and litigation. He is held in high esteem for his 'measured, calm and thoughtful approach.'" (Chambers USA 2013: New York: Litigation)

"'Experienced, thoughtful and results-driven'…He 'is calm under pressure, smart and strategic,' say sources." (Chambers USA 2011: New York: Litigation)
