A&O LNG specialists contribute to leading industry publication

​Allen & Overy is independently recognised as a market leader in the LNG industry. A multi-disciplinary team represents clients on a range of innovative projects across the globe, on the compliance and regulatory challenges and the major disputes which can arise in the sector.

Team members Angus Jones (Partner, Perth), Scott Neilson (Partner, Tokyo) and James Freeman (Counsel, London) contributed chapters to the third edition of Liquefied Natural Gas: The Law and Business of LNG, which was recently published by Globe Law & Business Ltd. This is the leading publication on the LNG industry.  It provides guidance on the legal, regulatory, political and practical elements of current LNG business.
 
Angus co-authored the chapter on Upstream challenges facing joint venture participants, given the challenging environment created by low prices and moderate recovery forecasts.  Angus, in conjunction with Daniel Gosewich (formerly General Counsel of client Arrow Energy), focused on both regulatory issues and challenges dealing with governments (including environmental regulation), and also challenges with joint venture partners.  The analysis includes practical commentary and case studies on specific provisions in standard joint operating agreements that are often tested when projects are not making the returns originally anticipated.
 
Scott authored the chapter on Export Credit Agencies (ECAs), a particularly relevant topic given the involvement of these bodies in almost all of the LNG project financings outside of the U.S. in the last decade. Through Scott’s unrivalled experience of advising and dealing with ECAs from all over the world, he explains in great detail what they are and why they are central to LNG project financings. The chapter also delves into the types of cover ECAs provide, the indirect benefits of involving them and, perhaps most valuably, how to do an ECA project financing outside of the U.S.
 
James, along with the leading energy economist Boaz Moselle from Cornerstone Research, co-authored the chapter on “Price reviews in practice”, focusing on common points of practice in gas and LNG pricing arbitrations. Allen & Overy has unrivalled expertise in this distinct specialism, having acted for both sellers and buyers in disputes under a number of governing laws and involving a variety of international markets. James uses his vast experience of price reviews to provide expert insight into the approach taken by arbitral tribunals to these disputes, the particular evidential challenges that arise, and the different procedural approaches relating to the adjustment of a price review.
