Our pensions practice deals with a range of pensions issues including:

  • M&A transactions – for example, advising on how to deal with pension commitments which transfer under Spanish law as part of an employee’s terms and conditions following the transfer of an undertaking;
  • collective dismissal processes; and
  • the recovery or transfer of consolidated rights under private pension schemes (mainly at a management level).

Our recent experience includes:

  • Advising parties to corporate transactions on the pension entitlements of employees, pension commitments under the applicable collective bargaining agreements and related duties in connection with these commitments.
  • Advising corporates in relation to requests from former employees to recover accrued pension entitlements or move entitlements to a new plan following termination of employment.
  • Advising a corporate on the offering of early retirement in the context of a collective dismissal process implemented as a result of a factory closure.
  • Advising companies on compulsory pensions paid by Spanish Social Security and retirement in Spain.
  • Advising on the eligibility for public retirement pension of a former executive of a Spanish company, where the individual’s only remaining link was as a Board member of a foreign group company.
