Employment and Benefits

Luxembourg

Our employment lawyers handle both contentious and non-contentious labour law matters exclusively for employers, mainly in the banking/financial services, insurance, ICT, industrial and retail sectors.

We advise clients on the full range of Luxembourg employment issues including contract design (also covering multi-employer relationships), flexible working time arrangements, remuneration policies, retention, bonus and stock option arrangements, secondment and expatriate agreements, immigration, retirement arrangements and individual dismissals (including settlement agreements and litigation).

We also provide intelligent and strategic advice on collective employment issues including collective dismissals, social plans, company agreements and mitigation plans (“plan de maintien dans l’emploi”), collective bargaining, employee transfers (in M&A deals and outsourcings) and staff representation (including social elections), as well as advising on more general workplace issues such as health and safety, codes of ethics and policies and conducting due diligence on labour law issues.

We have advised on Luxembourg’s largest social plans and employee transfers, demonstrating an innovative and pragmatic approach to sensitive issues.

With our strong background in contentious labour law matters, we can support our clients in employment-related litigation before all Luxembourg courts including the “Conseil arbitral des assurances sociales”.

What our clients say about us:

“Leading employment practice with a strong presence on complex contentious and advisory labour law issues, acting exclusively for employers. Regularly assists with collective employment issues, such as collective dismissals, social plans, company agreements and mitigation plans.” Chambers Europe 2016 (Employment)

“According to clients, market leader André Marc ‘understands general business in Luxembourg, not just labour law. If you need a sounding board to test your ideas and solutions, he’s good at listening and asking the right questions.’ His recent experience includes advising the Agricultural Bank of China on immigration and employment law aspects of the establishment of its business in Luxembourg.” Chambers Europe 2016 (Employment)

“Associate to watch Gilles Dall’Agnol is commended by clients for being an ‘expert in employment contracts.’ He deals with labour law matters in relation to M&A transactions.” Chambers Europe 2016 (Employment)
