Our cartel practice is also thriving and we frequently advise in licensing and anticompetitive agreements and have advised clients in a number of high profile international cartels and other national or EU investigations. In cartel enforcement our teams have broken new ground in the use of leniency programmes on a global scale.

The European Commission (Commission) is consulting on revised draft antitrust guidelines on the application of Article 101 TFEU (the prohibition against anti-competitive agreements) to horizontal co-operation agreements between companies, in particular agreements between competitors (the Draft Guidelines).
This is the first full ruling to be issued by the Competition Appeal Tribunal (the CAT) in English Welsh & Scottish Railway Ltd v Enron Coal Services Ltd [2009] EWCA Civ 647 and Enron Coal Services Ltd v English Welsh & Scottish Railway Ltd [2009] CAT 36 relating to a private damages claim under the Competition Act 1998 (the Act).
